General terms and conditions of use of the www.sncf-reseau.com website 

Introduction

The purpose of these General Terms and Conditions of Use (hereinafter the "GTCU") is to determine the conditions of access and rules for use of the SNCF Réseau Website accessible via the link: https://www.sncf-reseau.com  
Access to the Website is subject to compliance with these GTCU and is strictly restricted to the User as defined below.   
The Publisher reserves the right to unilaterally amend or update at any time these GTCU as required by any changes or additions made, in particular in order to comply with all legal, case law, publication and/or technical developments as well as any changes to the general terms and conditions of use of the Host’s services.   
The User must regularly consult the latest version of the GTCU, which are always available on the Website. 

Article 1 - Definitions 

In these GTCU, words or expressions beginning with a capital letter, whether in the singular or plural, shall have the following meanings:   
Cookie(s): means small computer files, placed and stored on the hard disk of the User's computer or mobile device such as a smartphone or tablet when the User logs into the Website and which retains certain information.  
Publisher: means SNCF Réseau.  
Host: means SNCF Connect & Tech.  
Information: means all the information and publications available on the Website.   
Request(s) and Opinions: means all the questions, requests and opinions that Users are able to send and/or publish via/on the Website.   
Website: means the Website proposed by the Publisher on the Internet from the address https://www.sncf-reseau.com  
User(s): means any person who has access to the Website, regardless of where they are and how they are logged in.

Article 2 - Purpose of the website  

The purpose of the Website is to provide Users with all information concerning SNCF Réseau's activities, services, news and projects.  
The Website collects and uses data about you solely for the purposes set out in these GTCU.  
Any use of the Website will be in compliance with these GTCU 

Article 3 - Access to and use of the Website 

 3.1 Access to the Website 

Access to the Website is possible from a computer, tablet or smartphone connected to a telecommunications network according to the communication protocols used on the Internet network.  
The Publisher grants the User a right to consult, use and access the Information on the Website. 

3.2 Access cost

Access to the Website is free and is not subject to any subscription. All software and hardware necessary for the use or operation of the Website, access to the Internet or communication fees are the exclusive responsibility of the User outside their workplace.  
Each User is fully responsible for his/her login data. Unless proven otherwise, any logging into the Website or transfer of data taking place from the User’s login information shall be deemed to have been carried out by the latter. 

3.3 Accessibility period  

The User’s access to the Website is for an unlimited period of time, without prejudice to the ability of the User or Publisher to unilaterally terminate it at any time, without notice, reason, or compensation. 

3.4 Use of the Website  

In particular and without this list being exhaustive, the User is prohibited from: 

  • using the Website for commercial purposes and in a general manner from offering products and services that directly or indirectly remunerate it; 
  • “reselling” or providing a third party and/or other Users with the content of the Website, for a fee and/or free of charge; 
  • using the Website to send, in any form whatsoever, unsolicited advertising or promotional material; directing Users indirectly or directly, in particular via hypertext links, to Websites that may not comply with applicable legislation or these GTCU. 

3.5 Information and functionalities provided 

The Website allows Users to: 

  • find out about SNCF Réseau and its news; 
  • find out about rail projects that are under consultation, being studied, implemented or completed, and submit opinions on these projects; 
  • read the Network Reference Document, which sets out all the technical, practical, administrative and pricing terms and conditions relating to the use of the French rail network, as well as the technical guidelines and documents; 
  • contact the Website administrators via the "Contact Us" section; 
  • access the Customer Portal. 

Article 4 - Availability of the website  

The Website is accessible 24 hours a day, 7 days a week, except in the case of a force majeure event or an occurrence beyond the Publisher's control. 

The Publisher reserves the right to suspend, interrupt or limit, without prior notice, access to all or part of the Website, in particular for maintenance and updating operations necessary for the proper functioning of the Website and related materials, or for any other reason, including technical. 

The Publisher is not bound by any obligation of result concerning the availability of the Website. Under no circumstances is the Publisher liable for any disruptions and consequences that may result in this respect for the User, particularly when the disruptions originate from those of the Host for its maintenance or other needs. 

The User is informed that the Publisher may terminate or change the characteristics of the Website at any time, without notice and without the User having any recourse against the Publisher. 

Article 5 - Hosting of the website   

Users are expressly informed that the content published on the Website is hosted and stored on the server of SNCF Connect & Tech, whose registered office is located at 2, place de la Défense - CNIT 1 - BP 440 - 92053 Paris la Défense.  

Article 6 - Requests and opinions   

User Opinions submitted via the Website's project pages are moderated a priori by one of the Publisher's moderators on the basis of their compliance with French laws and regulations and the requirements set out in Article 3.4 of these GTCU and, more generally, for any other serious reason. 

The Publisher reserves the right to refuse to publish any Opinion that violates these GTCU or that is likely to engage the liability of the Publisher and/or the Host in whole or in part. 

The User is responsible for any Opinion whose publication on the Website has been accepted by the Publisher, as well as for its consequences. The Opinion that the User submits for publication may be consulted by other Users of the Website. Users must only provide Opinions that they wish to share with others in compliance with the GTCU. 

The User undertakes to submit to the Publisher truthful information and content, distinctly showing the source and author in case of borrowing from a pre-existing work.  

Furthermore, Opinions must not:  

  • infringe intellectual property rights;  
  • violate the User's professional confidentiality obligations; 
  • be discriminatory or likely to incite violence or hatred on ethnic, political, sexual orientation grounds, etc.;  
  • contain obscene or pornographic material, etc.;  
  • harm the integrity and/or security of the Website and in particular include viruses, Trojan horses, worms, time bombs, cancelbots or any other computer program intended to damage, secretly intercept any computer system, data or personal information;  
  • be likely to make the Publisher and/or the Host liable by offering hypertext links to Websites or illegal, infringing content or, more generally, to content likely to breach the laws or regulations in force or to Websites with restricted access without authorisation from the rights holders of the content. 

The User represents that he/she is the one and only holder of any possible copyright to the Opinions and guarantees to the Publisher and/or the Host the free and entire enjoyment of all rights covered under these GTCU against any disturbances, claims and dispossessions of any kind.  

In particular, the User guarantees that no litigation or proceedings are in progress or about to be brought with respect to the Opinions challenging copyright. 

Article 7 – Intellectual property   

As a general rule, the User shall not infringe the intellectual property rights (copyright, related rights, sui generis database producer rights, trademark law, domain names, etc.) of the Publisher and/or the Host and/or any third party. 

The Publisher is the owner of all intellectual property rights both in the structure and in the content of the Website (texts, logos, images, sound elements, software, icons, layout, database, etc.) or has lawfully acquired the rights allowing exploitation of the structure and content of the Website, without any limitation. 

Thus, in particular, it is forbidden for the User to copy, reproduce, represent, change and/or exploit, transfer in any way and for any purpose, all or part of the structure and content of the Website, except with the Publisher’s express, prior and written authorisation. 

The Publisher authorises the downloading of photographs and videos. Any improper downloading observed may result in the Publisher and/or any third party concerned taking appropriate action. 

Any download of software offered by the Host on the Website shall comply with the terms and conditions of use of the Host. Before any downloading, the User must contact the Publisher to find out if this software is one of the services subscribed to by the Publisher with the Host. 

The User shall bear all consequences of infringements resulting from any downloading by the User without informing the Publisher and/or which breaches the Host’s terms and conditions of use. 

The trademarks and logos reproduced on the Website are registered with the competent Offices by the companies which hold them. Any reproduction of names or logos, by any means whatsoever, without prior authorisation from the holder concerned, shall be prohibited. 

The User may be held liable before a civil and/or a criminal court in the event of a failure to comply with these prohibitions, as this may, inter alia, constitute an act of counterfeiting and/or unfair and parasitic competition. 

Article 8 - Hypertext links 

Hyperlinks on the Website may redirect to other Intranet/Internet websites by any means. 

The User may set up hypertext links to other Websites. 

Article 9 - Personal data

All information relating to the processing of Users' personal data is detailed on the Website under the "Personal data" tab (https://www.sncf-reseau.com/protection-donnees-personnelles).

Article 10 - Confidential information management plan 

The Confidential Information Management Plan (PGIC), set up by SNCF Réseau to protect the confidentiality of information available to the company in its capacity as infrastructure manager, is accompanied by a specific alert system open to all SNCF Réseau agents and external or occasional collaborators only. 

The aim of this alert system is to be able to identify and deal with any proven (or strongly suspected) incidents in the protection of information qualified as confidential by the texts and the PGIC itself. 

As this system cannot be opened up to other persons outside SNCF Réseau, they are invited to inform the Legal and Compliance Department by post (SNCF Réseau, Direction Juridique et de la Conformité (Legal and Compliance Department) - "Alerte PGIC", 15/17 rue Jean-Philippe Rameau, CS 80001, 93418 La Plaine Saint-Denis cedex) in the event that they become aware of a proven (or strongly suspected) incident relating to the protection of information qualified as confidential by the PGIC, accompanied by any supporting evidence. 

This letter will be examined by the relevant SNCF Réseau departments in compliance with the PGIC alert system in force within the company. 

Article 11 - Cookies

All information relating to the placing of Cookies on Users' devices is detailed on the Website under the "Cookie management" tab.  

Article 12 - Warranties and Liability 

When using the Website, the User undertakes not to infringe any legal provisions and regulations in force, the good practices of the Intranet and netiquette, and these GTCU. 

The User is informed that any use of the Website in breach of the provisions of the GTCU is likely to incur liability and result in legal proceedings and penalties against him/her. 

The User covers the Publisher, as well as its parent, sister or affiliated companies, its representatives, employees and partners, against any request, complaint, claim and/or recourse of any kind resulting from any breach of the said provisions. 

Under the same terms and conditions, the User also undertakes to comply with the internal rules and practices relating to the use of the information systems and networks of the Publisher. 

The User undertakes to act diligently to respond to any complaints.   

The Publisher undertakes to take all necessary technical and organisational measures to protect the Information circulating on the Website and to guarantee the security of the personal data which it has collected and to avoid its disclosure to unauthorised third parties. 

Each User of the Website expressly undertakes: 

  • not to use software or processes intended to copy Website Information without the Publisher’s prior express authorisation; 
  • to expressly waive the right to use software or devices likely to disrupt the proper functioning of the Website, or to take action such as to impose a disproportionate burden on the Publisher's infrastructures; 
  • not to alter or amend or even create works derived from the Website Information without the Publisher's express and prior consent; 
  • not to extract or reuse, including for private purposes, without the Publisher’s prior written authorisation, a substantial or non-substantial part of the content of the databases and archives compiled by the Website; 
  • not to collect information on third parties, including e-mail addresses, in order to use it for sending commercial or similar advertising, or to integrate it into a referencing or similar service, either free of charge or for a fee, or even for the purposes of competitive intelligence; 
  • not to set up systems likely or of a nature to hack into the Website, either in whole or in part, or likely to violate these GTCU;  
    to inform the Publisher as soon as he/she becomes aware of any infringement (specifically of the Publisher’s intellectual property rights) in particular of any unlawful or non-contractual use of the Website Information, regardless of the method of dissemination used. 

The User who publishes an Opinion on the Website acknowledges that he/she is personally liable, both vis-à-vis third parties and the Publisher, in case of breach of the applicable legislative or regulatory provisions and consequently covers the Publisher against any disturbance, claim and dispossession whatsoever. 

Users are responsible for maintaining the confidentiality of the Opinions they publish on the Website.

Article 14 - Nullity of a clause 

Nullity either in whole or in part of one or more of the provisions of these GTCU, under a legal or regulatory provision or a court decision that has become final, does not result in the nullity of the other provisions or of the part of the provision not regarded as null and void.  

Article 15 - Applicable law - Settlement of disputes  

These GTCU are subject to French law. 

In the event of disputes relating to the interpretation, validity or performance of these GTCU, the User and the Publisher agree to do their best to settle the dispute amicably. 

In the event that an amicable settlement is not reached, any possible dispute relating to the interpretation or performance of these GTCU will be submitted to the jurisdiction of the courts of Paris.
